Lucas Elite Dental Studio, PLLC (“Lucas Elite Dental Studio,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, protect, and share information through our website and online features.
Because we are a dental office, some information you submit may be protected health information (“PHI”) under HIPAA, HITECH, and Texas law. PHI is also governed by our separate HIPAA Notice of Privacy Practices. If this Privacy Policy conflicts with our HIPAA Notice of Privacy Practices, the HIPAA Notice controls for PHI.
This website is not for emergencies. For a dental or medical emergency, call 911 or seek emergency care.

Information We Collect
We may collect information you provide, including your name, email address, phone number, appointment request, message content, insurance information if submitted, and information submitted by a parent or guardian for a minor patient.
We may also collect limited technical information automatically, including IP address, device type, browser type, pages visited, referring page, approximate location, date and time of visit, security logs, cookies, and similar browser-storage information.
If you arrive from an advertisement or referral link, we may receive campaign information such as UTM parameters or a click identifier. We use that information only as allowed by your cookie choices and only in a way that does not disclose PHI to advertising or analytics platforms.
Please do not submit Social Security numbers, payment card numbers, detailed medical history, or urgent clinical information through general website forms.

Information submitted to request dental care, schedule an appointment, provide insurance details, discuss a dental concern, or communicate about payment may be PHI.
We do not sell PHI. We do not use PHI for targeted advertising. We do not disclose PHI to Google, social media platforms, or advertising networks for advertising, analytics, conversion tracking, or audience-building.
Cookies and Tracking
We use cookies and similar technologies to operate the website, remember your cookie choices, support security, and, only with consent where required, measure website traffic or advertising performance.

Google Ads, Google Tag Manager, and Analytics
We may use Google tools on general informational pages to understand website and advertising performance.
We do not send Google your name, email address, phone number, appointment request, reason for visit, insurance information, dental history, treatment information, payment information, or patient-submitted form content from patient-related workflows.
Google tools must not be used in a way that creates HIPAA obligations for Google or discloses PHI to Google.
Vendors and Service Providers
We may use vendors for website hosting, scheduling, email, databases, workflow automation, security, analytics, and technical support.
When a vendor creates, receives, maintains, or transmits PHI for us, we require a HIPAA-compliant business associate agreement or another legally appropriate arrangement.
We may also disclose information when required by law, court order, subpoena, regulatory request, professional licensing inquiry, law enforcement request, or to protect patients, our practice, our workforce, or others.
We do not sell personal information or sensitive personal information.
Texas Electronic PHI Notice
Your protected health information may be subject to electronic disclosure. We may use or disclose PHI electronically for treatment, payment, health care operations, insurance-related functions, and other purposes allowed or required by HIPAA, HITECH, Texas law, or your written authorization.
When a separate authorization is required by law, we will obtain it.
Texas Privacy Rights for Non-PHI Data
Some website information may not be PHI. To the extent Texas consumer privacy law applies to non-exempt personal data, Texas residents may request access, correction, deletion, portability, and opt-out of targeted advertising, sale of personal data, or certain profiling.
To submit a request, contact us using the information above. We may need to verify your identity. If we deny an applicable request, you may appeal by contacting us again and stating that you are appealing the decision.
These rights do not override HIPAA, Texas dental-record laws, or other laws requiring or allowing us to keep dental, billing, insurance, business, or legal records.
Security
We use administrative, technical, and physical safeguards designed to protect personal information and PHI. No website, email, text message, or electronic storage system is completely secure. Please avoid sending sensitive clinical details through regular email, text, or general website forms unless we tell you the method is secure.
Data Retention
General website inquiries that do not become part of a patient record are typically kept for up to 24 months unless a longer period is needed.
Appointment, intake, billing, insurance, and clinical information may become part of the patient record and is retained under HIPAA, Texas dental rules, insurance requirements, and professional obligations.
Texas dental records are generally kept for at least five years from the last date of treatment. If the patient was under 18 at the last treatment, records are generally kept until the patient reaches age 21 or for five years from the last treatment date, whichever is longer. Certain orthodontic records may require longer retention.
Electronic health records under our control are maintained in the United States or a U.S. territory as required by Texas law.
Breach Response
If we discover a privacy or security incident involving personal information or PHI, we will investigate, take appropriate steps to reduce harm, and provide notices to affected individuals, HHS, the Texas Attorney General, TSBDE, or other authorities when required by law.
Children’s Privacy
The website is intended for adults, including parents and guardians seeking dental care for minors. We do not knowingly collect information directly from children under 13 without appropriate parent or guardian involvement.

Our website may link to third-party websites or services we do not control. We are not responsible for their privacy practices, security, or content.
